What Is a Settlement Demand?

Settlement Demand is a formal written request that an insurance company or opposing party pay a stated amount to resolve a personal injury claim. The demand explains the accident, identifies the injuries and losses, presents supporting evidence, and sets out the legal basis for payment. It begins settlement negotiations without filing a trial judgment.

Key Takeaways About Settlement Demand

  • A demand is a negotiation document, not a court order.
  • Supporting records connect claimed losses to the accident.
  • A demand is not the same as an insurance offer.

How Settlement Demand Works

A Settlement Demand organizes the claimant's position before settlement discussions begin. The document usually describes the collision, explains why another party is responsible, summarizes treatment and recovery, and identifies financial and personal losses. Records support the statements, while the requested payment gives the other side a clear proposal to assess.

The recipient reviews the demand and may accept it, reject it, request more information, or respond with a different offer. The exchange can continue through negotiation. A demand does not decide fault or require payment, and it does not prevent a claim from moving toward litigation when negotiations do not resolve the dispute. Medical records and insurance coverage can affect the strength and scope of the presentation.

From the Atlanta Auto Law team

When we prepare a Settlement Demand, we check that the accident facts match the available evidence and that the claimed losses connect to the documented injuries. We also review insurance information, treatment records, wage documentation, and other materials before presenting the demand in a car accident case.

Settlement Demand in Practice: A Real-World Example

After a Georgia car collision causes documented treatment, missed work, and continuing pain, a Settlement Demand can describe the crash, explain the driver's alleged negligence, attach supporting records, and request payment for the supported losses. The insurer may respond with questions or a different offer.
