What Is a Release?

A release is a legal document in which a person gives up specified claims against another party. In a car accident case, a release often relates to a settlement and identifies the claims, parties, and payment covered. Signing one may limit further recovery for the matters described in the document.

Key Takeaways About Release

  • A release is narrower or broader depending on its written terms.
  • Signing can affect future claims connected to the same accident.
  • A release is not the same as a demand letter.

How Release Works

A release works by identifying the claims a person agrees to give up in exchange for stated consideration, often a settlement payment. The document may name the parties, describe the accident, and define whether the agreement covers known claims, unknown claims, or both. The wording controls its practical reach.

In car accident representation, a settlement agreement and a release may appear together, but they serve different functions. The settlement describes the agreed resolution, while the release records the claims being relinquished. A medical lien or another payment obligation may require separate review because resolving the accident claim does not automatically resolve every related interest.

From the Atlanta Auto Law team

When we review a release, we examine the parties, covered claims, payment terms, and language about future or unknown injuries. We also compare the document with the accident record and settlement terms. Our team looks for wording that could affect medical expenses, liens, or claims that the proposed agreement does not clearly resolve.
