What Is Chain of Custody?

Chain of custody is a documented record that tracks physical evidence from collection through storage, transfer, testing, and presentation. The record identifies who handled an item, when the transfer occurred, and how the item was secured. In a medication error claim, the process can help show whether a medicine or package remained reliable evidence.

Key Takeaways About Chain of Custody

  • A custody record follows evidence through each transfer.
  • Secure storage and clear entries support evidence reliability.
  • Chain of custody is not the same as medical records.

How Chain of Custody Works

Chain of custody works by creating a continuous record for an item of evidence. The record begins when someone collects the item and continues as the item moves between people or locations. Each entry identifies the handler, the transfer, the storage setting, and any change in condition.

Medication records and related physical items may follow separate documentation paths. A prescription label can show what a pharmacy dispensed, while the medication container can provide physical evidence about packaging or labeling. If a gap appears, the legal team examines what happened during that period and whether the gap affects the item’s reliability.

From the Atlanta Auto Law team

When we review a medication error claim, we identify the physical evidence and trace each known handoff. We compare custody records with pharmacy documents, medical records, photographs, and witness accounts to assess whether the evidence remained identifiable and reliable.

Chain of Custody in Practice: A Real-World Example

A patient receives the wrong medication and keeps the container, label, and remaining pills. The legal team records who collected those items, where they were stored, and each later transfer so the evidence can be examined in context.
